Personal Information Exchange Practices
We use your Personal Information only for authentication of authorized users and permitted transactions, and for improving the Site. By using the Site, you agree to the collection and use of information in accordance with this policy.
Information Collection and Use
While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include but is not limited to your name and/or email (“Personal Information”).
Like many site operators, we collect “usage information” about your use of our Site and information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, the Web site that referred you to us, the pages you visit, and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this data.
We may use your Personal Information to contact you with our own newsletters, marketing or promotional materials and other information that is voluntarily provided during the use of this Site.
Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. We like many sites, advertising, and other data companies, use “cookies” and Web beacons to collect information, manage the Site, tailor our communications with you, and personalize your experience on the Site. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.
The security of your Personal Information is important to us, yet please remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information and take extra security measures in doing so, we cannot guarantee its absolute security.
- Children’s Privacy. DMX does not seek information from children under the age of 13.
- Phishing Scams. DMX will never ask you to update your personal information through email.
- Acceptance. By using the Site, you signify your acceptance of this Privacy Statement.

I. Information We Collect on our Site
A. Information You Provide to Us
When you create an account with DMX, you may be asked to provide certain Personal Information (information that can be used to identify you as an individual) such as your name, email, telephone number, address, demographic information (such as zip code, age), or payment information (such as account or credit card number). The types of Personal Information we collect may vary depending on your use of the features of the Site. For example, we may collect your credit card number and other payment-related information in connection with your purchase of services through the Site, and we may collect Personal Information when you submit comments or participate in sweepstakes, contests, games, special events, promotions, blogs and chats, and surveys (“Programs”). In addition, we may post customer testimonials/video testimonials on our Site which may contain personally identifiable information. We will obtain the customer’s consent via email prior to posting the testimonial to post their name along with their testimonial.
DMX may utilize third-party social media management services to collect and analyze publicly available information on various social media sites. Information that you post on those sites, as well as publicly available information that you post on other pages made available through those sites and on other social media sites, may be used by DMX for customer satisfaction, customized marketing, marketing analysis, consumer research, and other legitimate business purposes.
Friend to Friend: Some features on the Site may permit you to submit information about other people. For example, if you wish to invite your friends to participate in a Program offered through the Site or forward particular content from the Site to your friends, you may be asked to submit your friends’ email addresses. Our use, sharing, and protection of the other person’s information will also be subject to the terms of the Program and this Privacy Statement.
B. Information We Collect Automatically
Usage Information. Whenever you visit or interact with the Site, we, as well as any authorized third-party advertisers and/or service providers, may use a variety of technologies that automatically or passively collect information about how the Site is accessed and used (“Usage Information”). Usage Information may include browser type, device type, operating system, application version, the page served, the time, the preceding page views, and your use of features or applications on the Site, such as interactions with friends and group activities. This information helps us keep our Site fresh and interesting to our visitors and allows us to tailor content to a visitor’s interests. Usage Information is generally non-identifying, but if DMX associates it with you as a specific and identifiable person, DMX treats it as Personal Information.
When you sign into your DMX account, we may create a record of your sign-in, which includes the date and time, information about the service you signed into, your sign-in name, the unique number assigned to your account, a unique identifier assigned to your device, your IP address, and your operating system and browser version. Signing into your account enables improved personalization, provides seamless and consistent experiences across services and devices, and allows you to access and use cloud data storage and other enhanced features and settings. When you sign into your account, you will stay signed in until you sign out. When you are signed in, some services may display your name or username and your profile photo (if you have added one to your profile) as part of your use of Site, including in your communications, social interactions, and public posts.
Device Identifier. We may automatically collect your IP address or other unique identifiers (“Device Identifier”) for the Device (computer, mobile phone, tablet or other devices) you use to access the Site. A Device Identifier is a number that is assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. We, and our affiliates, service providers, business partners and other third parties, including authorized dealers, may use a Device Identifier to, among other things, administer the Site; help diagnose problems with our servers; analyze trends; track users’ web page movements over time and across different websites, the Site, or other mobile, online, or offline services; to help identify you and your shopping cart, and gather broad demographic information for aggregate use.
Error Reports and Performance Data. We collect data about the performance of the Site and any problems you may experience with it. This data helps us to diagnose problems in the applications of the Site you use, and to improve our services and provide solutions. Depending on your settings, error reports can include data such as the type or severity of the problem, details of the software or hardware related to an error, contents of files you were using when an error occurred, and data about other software on your device.
Location data. We may collect data about your location, which can be either precise or imprecise. Precise location data can be Global Position System (GPS) data, as well as data identifying nearby cell towers and Wi-Fi hotspots, we collect when you enable location-based services or features. Imprecise location data includes, for example, a location derived from your IP address or data that indicates where you are located with less precision, such as at a city or postal code level.
Cookies; Pixel Tags. The technologies used on the Site to collect Usage Information, including Device Identifiers, include but are not limited to: cookies (data files placed on a Device when it is used to visit the Site), mobile analytics software and pixel tags (transparent graphic images, sometimes called web beacons or tracking beacons, placed on a web page or in an email, which indicates that a page or email has been viewed). Cookies may also be used to associate you with social networking sites like Facebook and Twitter and, by using one of their applications either on or otherwise connected to our Site (e.g. social media log-in credentials or vehicle configuration shared to social media), you may enable interaction between your activities on the Site and your activities on such social networking sites.
We, or our authorized vendors, may place cookies or similar files on your Device for security purposes, to facilitate site navigation and to personalize your experience while visiting our Site (such as storing your preferences and setting; keeping you signed into our Site; and allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic information). Please note that Dealer Advertising Associations may opt to place cookies or similar files on your Device to personalize your experience on their websites. A pixel tag may tell your browser to get content from another server.
Most web browsers automatically accept cookies but provide controls that allow you to block or delete them. To learn how you may be able to reduce the number of cookies you receive from us or delete cookies that have already been installed in your browser’s cookie folder, please refer to your browser’s help menu or other instructions related to your browser. If you do disable or opt out of receiving cookies, please be aware that some features and services on our Site may not work properly because we may not be able to recognize and associate you with your DMX account(s). In addition, the offers we provide when you visit us may not be as relevant to you or tailored to your interests. If you block or delete cookies, not all tracking that we have described in this privacy statement may stop.
Certain features of the Site depend on cookies. Please be aware that if you choose to block cookies, you may not be able to sign in or use those features, and preferences that are dependent on cookies may be lost. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, will be deleted and may need to be recreated.
In addition to standard cookies and web beacons, our Site and services may also use other similar technologies to store and read data files on your computer. This is typically done to maintain your preferences or to improve speed and performance by storing certain files locally. But, like standard cookies, these technologies can also be used to store a unique identifier for your computer, which can then be used to track behavior.
Do Not Track. Some browsers have incorporated a “do not track” feature that lets you tell websites you visit that you do not want to have your online activities tracked. Because these features are not yet uniform and there is no common understanding of how to interpret these signals, we are not currently set up to recognize and respond to these signals. We continue to work with the online industry to define a common understanding of how to treat DNT signals. In the meantime, you can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving interest-based advertising from Microsoft as described above.
II. How We Use the Information We Collect
We may use the information we collect about and from you for a variety of business purposes such as to:
- Respond to your questions and requests such as requests for services information and brochures;
- Enable you to participate in promotional activities or other Programs;
- Provide you with access to certain areas and features of the Site such as your interactions with other users;
- Verify your identity;
- Communicate with you about your account and activities on the Site and, in our discretion, changes to any DMX policy or notice;
- Tailor content, advertisements, and offers we serve you, including by providing more relevant content, advertisements, and offers over time and across multiple devices;
- Improve the Site;
- Comply with license obligations;
- Diagnose problems and provide other customer care and support services;
- Continually improve the Site, including adding new features or capabilities, such as the use of error reports to improve security features and Usage Data to determine what new features to prioritize;
- Protect the security and safety of our Site and our customers, and to detect and prevent fraud;
- Develop aggregate analysis and business intelligence that enable us to operate, protect, make informed decisions, and report on the performance of our business; and
- For purposes disclosed at the time you provide your Personal Information or otherwise with your consent.
You may share your location with us and we may use it for the purpose of providing you with offers and other information relevant to your location.
III. Sharing of Information
Except as described here, we will not provide any of your Personal Information to any third parties without your express consent. We may share your Personal Information in order to complete any transaction or provide a service you requested through the Site. When you provide payment data to make a purchase, we may share payment data with banks and other entities that process payment transactions or provide other financial services, and for fraud prevention and credit risk reduction.
We may share Non-Personal Information, such as aggregate data and Usage Information with any authorized third parties. We may also share your information as disclosed at the time you provide your information, as set forth in this Privacy Statement and in the following circumstances:
Third Parties Providing Services on Our Behalf. We may share your Personal Information with authorized third parties that perform functions on our behalf (or on behalf of our partners) such as service providers that host or operate our Site, analyze data, process transactions and payments, fulfill orders or provide customer service; advertisers; sponsors or other third parties that participate in or administer our promotions, surveys or provide marketing or promotional assistance and “powered by” partners or partners in co-branded sites. Your Personal Information may also be used by us or shared with our subsidiaries, affiliates, sponsors, partners, advertisers or other third parties to provide you with services information and promotional and other offers.
Surveys. We may require you to provide certain demographic information (such as gender and zip code) when conducting surveys on our Site. We may use the information you disclose to us, including your answers to survey questions, for detailed purposes prior to your participation in the survey. In some cases, we may publish the survey results, but only as aggregate or joint information, and you will not be identified individually. As we conduct certain surveys with our business partners or third parties, we may also share the anonymous results of those surveys with the aforementioned third parties; however, we will not share your Personal Information.
Business Transfers. We may share your Personal Information with other entities and our affiliates primarily for business and operational purposes. In the event that DMX is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction.
IV. Information We Receive from Third Parties
We may receive information about you from third parties.
Websites. For example, if you are on another website and you opt-in to receive information from DMX, that website may submit to us your email address and other information about you so that we may contact you as requested.
Third Party Applications. You may also choose to participate in a third-party application or feature (such as one of our Facebook or Twitter applications or a similar application or feature on a third-party website) through which, through your participation, you allow us to collect (or the third party to share) information about you, including Usage Information and Personal Information such as lists of your friends, “likes”, comments you have shared, groups and location. Services like Facebook Connect give you the option to post information about your activities on our Platform to your profile page to share with others within your network. In addition, we may receive information about you if other users of a third-party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections’” web page, profile page, or similar page on a social networking or other third party website or interactive service.
Other Third Parties. We may also receive information about you from our affiliates, service providers, business partners, and other third parties, including authorized dealers. Information from such third parties may have been collected online, offline, or through publicly – or commercially available sources.
V. Your Privacy Rights, Choice, and Access
The Site gives you choices. If you elect to receive emails from us about services and other information, we strive to keep your Personal Information updated and accurate.
If you provided DMX with Personal Information through the Users section of dmx.io, you may review and update that information by clicking on the Users link on the homepage of dmx.io, registering or logging in and then clicking on “Update Profile.”
For users who are not currently registered on our user site, please call Customer Satisfaction at 844-369-2001 to opt out from receiving email communications from DMX. If you receive an e-mail, you may opt-out at any time by following the opt-out instructions provided in the e-mail you receive. Your opt-out request will be processed within 30 days of the date on which we receive it.
If you are participating in a Program, you may be able to access and update the information you provided as part of your participation in the Program. Please see the section of the Site concerning the specific Program to determine if you are able to access your information and how to do so.
In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Site. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. It may not always possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons. We may retain your information (including geo-location data) for as long as your account is active or as needed to provide you services. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We do not control certain privacy settings and preferences maintained by our social media partners like Facebook and Twitter. If you wish to make changes to those settings and preferences, you may do so by visiting the settings page of the appropriate social media site.
VI. Advertising/Behavioral Targeting; How to Opt-Out
If you prefer to not receive targeted advertising, you can opt-out of some network advertising programs that use your information. To do so, please visit their opt-out pages. Please note that even if you choose to opt-out of targeted advertising, you may still see advertisements while you’re browsing online. However, the advertisements you see may be less relevant to you and your interests. Additionally, many network advertising programs allow you to view and manage the interest categories they have compiled from your online browsing activities. These interest categories help determine the types of targeted advertisements you may receive. The opt-out pages provide a tool that identifies its member companies that have cookies on your browser and provides links to those companies.
The Site is not directed to children under 13. In accordance with the Children’s Online Privacy Protection Act of 1998 (COPPA), we do not knowingly collect, use, or disclose personally identifiable information from anyone under 13 years of age. If we determine upon collection that a user is under this age, we will not use or maintain his/her Personal Information without the parent/guardian’s consent. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.
VIII. Security of Your Information and Phishing Scams
We take information security seriously and use certain reasonable security measures to help protect your Personal Information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Platforms and provide us with your information at your own risk. When we collect sensitive information on our sites or within our mobile application (such as credit card number or geo-location information), we encrypt the transmission of that information using secure socket layer technology.
Personal data collected by DMX may be stored in a secure cloud environment, in the United States or in any other country where DMX or its affiliates, subsidiaries or service providers maintain facilities. We take steps to ensure that the data we collect under this privacy statement is processed according to the provisions of this statement and the requirements of applicable law wherever the data is located.
Beware of Phishing Scams: Globally, there have been noticeable increases in the number of suspicious emails claiming that the email recipient has won a lottery or other promotion. In order to claim the prize, the email asks that Personal Information is sent to an email address.
This type of email solicitation is known commonly as a “phishing” scam, with the primary objective being to obtain one’s personal information. This information can then be utilized to steal a person’s identity. DMX will never ask you to send passwords, login names, Social Security numbers, or other personal information through email or U.S. mail or fax or text message. If you receive an email or letter by U.S. mail or fax or text message from DMX asking you to update your credit card information, do not respond: this is a phishing scam. Recipients of suspicious email like this should delete the message from their inbox and, if possible, update their email filter settings to block emails from the email address being used. The Federal Trade Commission and the Antiphishing Workgroup are also good sources of information about these types of security threats and how they may be reported to the authorities.
IX. Other Sites
The Site may contain links to other sites that we do not own or operate, as well as links from advertisers, sponsors and/or partners. We do not control, recommend, or endorse and are not responsible for these sites or their content, products, services or privacy policies or practices, even though they may use the DMX name or logo on their site through an agreement with us. These other sites may send their own cookies to your Device, they may independently collect data or solicit Personal Information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of our Site (including those linked to through an email or social networking page).
X. Consent to Process and Transfer Information
The Site is governed by and operated in, and in accordance with the laws of, Puerto Rico and the United States, and are intended for the enjoyment of residents of the United States. DMX makes no representation that the Site is governed by or operated in accordance with the laws of any other nation. Given that we are an international business, our use of your information necessarily involves the transmission of data on an international basis. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the Site, or providing us with any information, you (a) acknowledge that the Site is subject to the laws of the United States, (b) consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.
